1. Agreement

Plain language: By using operator.fyi, you agree to these terms. If you do not agree, do not use the service.

These Terms of Service ("Terms") govern your access to and use of operator.fyi and all related services ("Service") provided by Operator AI LLC ("Operator", "we", "us"). By accessing or using the Service, you agree to be bound by these Terms.

2. Accounts

Plain language: You need an account for paid features. Keep your password safe. Tell us if someone else gets in.

To access certain features of the Service, you must create an account. You agree to provide accurate information, maintain the security of your credentials, and notify us of any unauthorized access.

3. Service description

Plain language: We offer a free tier, AI Sites at $49/month, and Autopilot at $499/month. We can change features with notice.

Operator provides market intelligence and business management services across three tiers: Free, AI Sites ($49/mo), and Autopilot ($499/mo). We reserve the right to modify, suspend, or discontinue any aspect of the Service with reasonable notice.

4. Subscription and billing

Plain language: Paid plans auto-renew every month. You can cancel any time before the next billing date.

Subscriptions bill monthly in advance. You authorize us to charge your payment method on each renewal date. Refunds are not provided for partial periods unless required by law.

5. Cancellation

Plain language: Cancel any time from /billing. Access continues until the end of your paid period.

You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription will remain active until the end of the current billing period, after which the Service will be downgraded to the Free tier.

6. Data ownership and portability

Plain language: Your data is yours. You can export it any time. We delete it within 30 days of cancellation.

You retain all rights to data you provide or generate through the Service. Upon request or account termination, you may export all your data in a machine-readable format. We delete your data within 30 days of termination, except where retention is required by law.

7. Acceptable use

Plain language: Do not use Operator to spam, scrape, hack, or break the law.

You agree not to use the Service to: violate any law, infringe on others' rights, send unsolicited messages, interfere with Service operation, or reverse engineer the platform.

8. Intellectual property

Plain language: We own our software and brand. You own your business data.

Operator retains all rights to the Service, including software, trademarks, and trade secrets. You grant us a limited license to use your business data solely to provide the Service.

9. Warranties and disclaimers

Plain language: We work hard to make Operator reliable, but we cannot promise perfection.

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted availability, error-free operation, or specific outcomes from use of the Service.

10. Limitation of liability

Plain language: If something goes wrong, our liability is capped at what you paid us in the last 12 months.

To the maximum extent permitted by law, Operator's total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify Operator against claims arising from your use of the Service or violation of these Terms.

12. Dispute resolution

Any disputes will be resolved through binding arbitration in Wyoming, except where prohibited by law.

13. Governing law

These Terms are governed by the laws of the State of Wyoming.

14. Changes to terms

We may update these Terms. Material changes will be notified 30 days in advance via email.
